Terms and Conditions
Version: August 2026
for the holiday houses Haus Blau (C) and Haus Grün (D), Bremer Straße 32, 34393 Grebenstein-Burguffeln, Germany
This English translation is provided for convenience. The German version of these terms (Allgemeine Geschäftsbedingungen) is the legally binding text.
§ 1 Scope
- These General Terms and Conditions apply to the letting of the holiday houses “Haus Blau” (House C) and “Haus Grün” (House D) at Bremer Straße 32, 34393 Grebenstein-Burguffeln, Germany, by Bröckel Grundbesitz eGbR, Weimarer Weg 2, 34393 Grebenstein, Germany, email: anfrage@ferien-burguffeln.de.
- The holiday houses are let exclusively for temporary accommodation.
- These terms apply to bookings agreed directly with Bröckel Grundbesitz eGbR. For bookings made through external booking platforms, the conditions agreed there apply in addition or take precedence where they differ from these terms.
§ 2 Booking enquiry and conclusion of the contract
- The presentation of the holiday houses and the available services on the website does not yet constitute a binding offer to conclude an accommodation contract.
- Via the enquiry form on the website, the guest can submit a non-binding booking enquiry. An enquiry by email, telephone or any other means likewise does not constitute a binding booking.
- After receiving the enquiry, Bröckel Grundbesitz eGbR checks availability. If the requested holiday house is available, the guest receives an offer stating the essential booking details, in particular the holiday house, the travel period, the number of persons and the total price.
- The guest can then expressly confirm this offer. Only with this confirmation by the guest does the accommodation contract come into effect and the booking become binding.
- The guest is obliged to check the booking details contained in the offer before confirming and to report any errors or discrepancies.
§ 3 Prices and terms of payment
- The total price stated in the offer of Bröckel Grundbesitz eGbR applies to the agreed stay.
- Once the accommodation contract has been concluded, a deposit of 30 % of the total price is due. The payment details are provided to the guest with the booking confirmation.
- The remaining balance of 70 % of the total price is due no later than 14 days before the agreed arrival date.
- If the binding booking is made less than 14 days before the arrival date, the entire price is due immediately after the contract is concluded.
- Receipt of the payment by the landlord is decisive for whether a payment is made on time.
§ 4 Cancellation by the guest
- The guest may cancel the booking before the start of the stay. The cancellation must be declared in text form, in particular by email to anfrage@ferien-burguffeln.de.
- In the event of a cancellation, the following cancellation charges apply:
- up to 30 days before arrival: free of charge
- 29 to 15 days before arrival: 30 % of the agreed total price
- 14 to 8 days before arrival: 70 % of the agreed total price
- from 7 days before arrival: 90 % of the agreed total price
- In the event of a no-show without prior cancellation, 90 % of the agreed total price is charged.
- Payments already made are credited against the cancellation charges. If the amount already paid exceeds the cancellation charges, the difference is refunded to the guest.
- If the landlord succeeds in letting the holiday house to someone else for all or part of the cancelled period, the resulting proceeds and any saved expenses are taken into account when calculating the claim.
- The guest expressly remains entitled to prove that the landlord suffered no loss, or a substantially smaller loss, as a result of the cancellation.
§ 5 Arrival, departure and access to the holiday house
- Check-in is possible on the day of arrival from 16:00, by prior arrangement. Check-in is self-service: the key is left for the guest in the front door of the booked holiday house.
- By prior arrangement, an early check-in from 14:00 is possible for a surcharge of €15.00.
- Check-out on the day of departure must take place by 11:00 at the latest.
- By prior arrangement, a late check-out until 13:00 is possible for a surcharge of €15.00.
- On departure, the key is to be left in the front door of the holiday house again.
- Different arrival or departure times require prior agreement with the landlord.
§ 6 Occupancy and use of the holiday houses
- The holiday houses may only be used by the number of persons stated and agreed at the time of booking.
- The following maximum occupancy applies to the two holiday houses:
- Haus Blau (House C): a maximum of 4 persons.
- Haus Grün (House D): for stays of more than one night, a maximum of 4 persons. For a stay of exactly one night, occupancy by a maximum of 5 persons is possible.
- In addition, a baby can be accommodated in a cot in either holiday house. The baby does not count towards the maximum occupancy under paragraph 2. No additional accommodation charges apply for the baby.
- If a cot is needed, please state this in the booking enquiry so that it can be provided for the stay.
- Exceeding the agreed number of persons or accommodating additional overnight guests is only permitted with the landlord’s prior consent.
- The holiday houses may only be used for the agreed purpose of accommodation. Subletting or handing the house over to third parties is not permitted without the landlord’s prior consent.
§ 7 House rules
- The holiday houses are non-smoking accommodation. Smoking inside the holiday houses is not permitted. Smoking is allowed exclusively on the respective terrace.
- Pets are not permitted.
- Parties and events are not permitted in the holiday houses or on the associated outdoor areas.
- Quiet hours apply from 22:00 to 06:00. During this time, noise must be kept to a reasonable indoor level, with particular consideration for the neighbourhood and other guests.
- Guests are obliged to treat the holiday houses, furniture, furnishings, technical equipment and the outdoor areas with care.
- Damage or defects that arise or are discovered during the stay must be reported to the landlord without delay.
§ 8 Damage, cleaning and the guest’s responsibility
- The guest is obliged to treat the holiday house and the furniture, furnishings, technical equipment and other fittings in it with care.
- Damage or defects that arise or are discovered during the stay must be reported to the landlord without delay.
- The guest is liable under the statutory provisions for damage culpably caused by the guest or by persons the guest brings along or is responsible for. This also applies to damage to the outdoor facilities and other installations belonging to the holiday house.
- On departure, the holiday house must be left in a tidy and broom-clean condition. Crockery and kitchen utensils must be cleaned and left in their designated places. Waste must be disposed of in the containers provided.
- A one-off cleaning charge is made for the final cleaning. It amounts to €15.00 for stays of up to 4 nights and €25.00 for stays of 5 nights or more. The cleaning charge is shown separately in the offer and forms part of the agreed total price.
- In the case of exceptional soiling caused by the guest that clearly exceeds the usual cleaning effort after a holiday stay, the additional cleaning effort actually incurred may be invoiced.
- Damage caused by the guest may only be claimed in the amount of the repair or replacement costs actually required. Normal wear and tear from use of the holiday house in accordance with the contract does not count as damage.
- If a key provided is lost, €25.00 per key is charged for the replacement. If the loss of the key makes it necessary for safety reasons to replace a lock or lock cylinder, the necessary costs actually incurred may be charged in addition.
§ 9 Defects and the landlord’s liability
- The landlord is obliged to make the booked holiday house available for the agreed period in a condition suitable for use in accordance with the contract.
- If the guest discovers a defect or disturbance during the stay, the landlord must be informed without delay. The landlord must be given the opportunity to remedy the defect within a reasonable period.
- The guest should take reasonable steps to prevent any damage that has occurred from increasing.
- The landlord is liable without limitation for damage resulting from injury to life, body or health insofar as it is based on an intentional or negligent breach of duty by the landlord or the landlord’s vicarious agents.
- For other damage, the landlord is liable under the statutory provisions in cases of intent and gross negligence. In cases of slight negligence, the landlord is liable for the breach of essential contractual obligations; in that case, liability is limited to the foreseeable damage typical of the contract.
- Mandatory statutory liability claims of the guest remain unaffected by the above provisions.
§ 10 Wi-Fi and internet access
- In both holiday houses, guests have free Wi-Fi internet access during their stay.
- Wi-Fi access is an additional service. Uninterrupted availability at all times or a particular transmission speed cannot be guaranteed. Temporary restrictions or outages may occur, in particular due to technical faults or circumstances beyond the landlord’s control.
- The guest is obliged to use the internet access exclusively within the bounds of the law. In particular, no unlawful content may be retrieved, distributed or made accessible via the internet access provided, and no rights of third parties may be infringed.
- The guest is liable under the statutory provisions for culpable infringements of the law in connection with the use of the internet access provided.
§ 11 Right of withdrawal
- There is no statutory right of withdrawal for the booking of the holiday houses, as the accommodation service is provided for a specifically agreed period. This also applies if the accommodation contract is concluded by email or by other means at a distance.
- The statutory rules excluding the right of withdrawal for accommodation services follow from § 312g (2) no. 9 of the German Civil Code (BGB).
- Irrespective of this, the guest may cancel the booking in accordance with the cancellation conditions set out in § 4 of these terms.
§ 12 Withdrawal and termination by the landlord
- The landlord is entitled to withdraw from the accommodation contract before the start of the stay, or to terminate the contract extraordinarily during the stay, for good cause.
- Good cause exists in particular if:
- the guest fails to make payments that are due despite a reminder and a reasonable payment deadline,
- materially false information was deliberately given at the time of booking,
- the holiday house is occupied without consent by more than the agreed or permitted number of persons,
- unregistered pets are brought along,
- serious or repeated breaches of the house rules or the agreed quiet hours occur despite a prior warning,
- the holiday house is used for purposes not agreed, in particular for parties or events, or
- the guest’s conduct creates a significant risk to the holiday house, its furnishings or other persons.
- If the contract is terminated for good cause attributable to the guest, the landlord’s statutory claims remain unaffected. Saved expenses and income from letting the house to someone else are taken into account.
- If the landlord cannot make the booked holiday house available for a reason the landlord is responsible for, payments already made for the accommodation services not provided are refunded. Further statutory claims of the guest remain unaffected.
§ 13 Final provisions
- The law of the Federal Republic of Germany applies to the accommodation contract. Mandatory consumer-protection provisions remain unaffected.
- Individual agreements between the landlord and the guest take precedence over these General Terms and Conditions.
- Should individual provisions of these terms be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected. The statutory provisions take the place of the invalid provision.
